In addition to John’s extensive transactional background, he is also an experienced commercial litigator. He has represented lenders and borrowers in commercial foreclosures and receiverships and has represented court-appointed receivers and other fiduciaries. This litigation background provides helpful insight when dealing with situations that “go bad” and helps steer clients clear of some of the common pitfalls in commercial transactions. When necessary, John’s litigation experience is also helpful when our real estate clients need to negotiate alternatives to foreclosure, such as loan modifications and workouts or deeds-in-lieu of foreclosure.
The firm issues title insurance through Old Republic National Title Insurance Company, and John has closed commercial transactions as an “approved attorney” for several other national title insurance underwriters.
** John became Board Certified in Real Estate Law in 2001, which was the first year he was eligible under the Florida Bar’s certification rules. As of October 2020, only 30 of the more than 11,640 lawyers in Broward County are Board Certified by the Florida Bar in Real Estate Law, and John is the only Board Certified Real Estate Lawyer in Weston.
Representative Matters:
- Represented property owners in $10MM and $9.5MM refinance of related shopping centers with defeasance of previous mortgage loans and subsequent cross-collateralization of loans
- Represented developer in negotiation of Development Agreement with local community redevelopment agency for construction of a mixed-use project on eleven parcels comprising 36.5 acres with 968 residential units, 100,000 square feet of commercial space, a parking structure, and various civic and community components
- Represented developer (ground lessee) in negotiation and closing of a $8MM construction / permanent loan for construction of a 3-story / 49-unit, Class A multi-family apartment building
- Represented developer (ground lessee) in negotiation and closing of construction financing secured by multiple parcels for financing infrastructure improvements and commercial improvements as part of the Pompano Beach pier and beach redevelopment project
- Represented developer in negotiating acquisition of multi-family component of a mixed-use development (157 residential units including townhomes and condominium units)
- Represented developer in acquisition and construction financing for two parcels being re-developed as 23,000 SF of Class A medical office space
- Represented purchaser/borrower in purchase and financing of office building for partial owner occupancy with balance for investment
- Represented various developers in acquisition of numerous properties with development and construction financing for redevelopment as commercial office space, luxury townhomes, and custom waterfront homes
